MINISTRY OF JUSTICE OF RUSSIAN FEDERATION HAS PREPARED A DRAFT LAW TO ENSURE THE OPERATION OF THE SUPERSERVICE «DIGITAL ENFORCEMENT PROCEEDINGS»

The Ministry of Justice proposes to amend such federal laws as the Labor Code, the Tax Code, the Code of Administrative Offenses, as well as the Criminal Procedure Code of Russia, in order to ensure the operation of the Digital Enforcement Proceedings superservice.
The draft law is primarily aimed at reducing possible corruption interaction between citizens, organizations and bodies responsible for the execution of court decisions, as well as decisions of other state authorities.
Superservice assumes a transition to a «registry model» for the execution of acts of public authorities. According to the draft law, the register is an electronic information resource designed to record Enforcement documents in the course of compulsory execution. It is assumed that after the start of the superservice, the issuance of Enforcement documents will not be carried out. This process will be replaced by the registration of the Enforcement document in the electronic register. Thus, for example, the basis for withholding funds for debts will not be the original Enforcement document, but an electronic record in this register.
It is assumed that the creation of an electronic register will reduce the need for personal contacts with government officials, and increase the transparency of the work of officials responsible for the execution of decisions of state authorities. In addition, superservice will simplify the process of enforcement proceedings, as well as reduce the financial costs associated with the process of executing decisions of the authorities.
