A new project providing for amendments to the regulation of the status of officials holding public positions in the authorities of the subjects of the Russian Federation.

Currently according with article 12-1 of the Federal law act "On combating to the corruption" for officials holding public positions in the authorities of the subjects of the Russian Federation forbidden to engage in entrepreneurial activity in person or through proxies and engage in another paid activity, except for teaching, scientific and other creative activities. Also, deputies of the legislative assemblies of the subjects of the Russian Federation do not have the right to participate in the management of a commercial and non-commercial organization, except when this directly arises from federal law act.

But in Federal law act "About general principles regulation legal status the legislative assemblies of the subjects of the Russian Federation" status of deputy of the legislative assemblies of the subjects of the Russian Federation providing opportunity work in legislative assembly without interrupting main job. In that case deputy perform duties at no cost.

Therefore, there are currently contradictions between the Federal Law "On Combating Corruption" and the Federal Law "On General Principles of Regulation of the Legal Status of Legislative Meetings of the Subjects of the Russian Federation". This contradiction causes the formation of a uniform practice, which creates difficulties in the implementation of the powers of deputies.

The draft proposes to clarify that deputies of legislative assemblies working on an intermittent basis can participate in the management of commercial organizations. At the same time, for those regional parliamentarians who work on a permanent basis, the ban remains the same.
